that's how you get on the air. the spin stops right here. we're definitely looking out for you. >> sean: this is a fox news alert. tonight there are top major two late breaking developments in scandals. a short time ago at the white house the president made a rare late-day appearance before cameras to announce the resignation of the acting commissioner of the irs. now, that departure comes days after we learned about the tax agency's efforts to target conservative organizations during the 2012 election cycle. we'll have much more on the president's remarks and the fallout from the irs's enemies list scandal over the course of the next hour. now, meanwhile tonight the white house has released 100 pages of emails related to the benghazi talking points. now, republicans have been asked

for this informsto be made public for quite some time as they continue to investigate who was responsible for editing these documents. now, you may recall that the white house has denied making any substantive revisions prior to susan rice's appearances on the five sunday talk shows, but is there anything in this unexpected document dump to prove otherwise? our very own james rosen has been scouring the emails has the answers. james? >> these emails raise a number of questions, but already appear on their face to contradict statements by white house press secretary jay carney. here's one of them. >> the only edits paid by anyone at the house were stylistic, nonsubstantive. they corrected the description of the building where the facility in benghazi from consulate to diplomatic facility and the like. >> in fact, fairly early in the process, at 6:52 p.m. on

september 14, john brennan, then a white house staffer, now director of cia, passed along his changes, including striking a line about the intruders having hailed from across many sectors of libyan society. on september 18th, carney said this at the white house. >> our initial information -- and that includes all information, we saw no evidence to back up claims by others that this was a preplanned or premeditated attack. >> no evidence. in fact, the cia's early draft of the talking points stated, quote, we do know that islamic extremists with ties to al-qaeda participated in the attack. that language survived for about five hours. by 4:42 p.m. on the 14th, however, al-qaeda, an attack, were gone, replaced with violent demonstrations. nonetheless, at 9:43 that night a cia official wrote to a colleague at langley, fbi says al-qaeda, not al-qaeda in the islamic ma grab, was involved, and they're pursuing that

theory. we're not ahead of law enforcement now. so are we clear to send to congress? the answer came back no, and the scrubbing of the talking points accelerated over the following day, a saturday. there's more, sean, much more to these documents, including a reference by then state department spokeswoman vick territory ya nuland. sean? >> sean: james, big development tonight, thank you so much. for more on the breaking news, we turn now to the reporter who first exposed the white house and state department's involvement in editing he's official talking points. joining me from the "weekly standard" our friend steven hayes is back with us. 12 different versions emerged. the first one was right. by the 12th, an entire we know of lies -- web of lies was

built. what do you take out of the emails that you originally reported? >> well, i think they do. i mean, i think that's sort of the big story, confirm the stuff that we've reported before. and i think they do put jay carney in quite a difficult position. remembering, he had said that the white house and the state department had made but one single minor adjustment to these talking points, very clear by looking at the cia's own account of what happened in their own knowledge, that that wasn't the case. you have a cia email that talks about the state department objecting to much or most of the document was the way they put it. and said they were making further revisions with the state department in mind. you have contradictions of hillary clinton. back in january, she said the intelligence community was the principal decider, was the way she phrased it on all of these questions, when in fact it seems

there were many senior state department officials, those around hillary clinton, pushing to make these revisions that ultimately led from the strong version being thrown out and replaced by a much weaker version 24 hours later. >> sean: there's specific references here, like on page 51. i spoke with tommy. we'll work through this morning, get comments back, meaning they'll get the comments back from the state department and white house. similarly page 47, victoria nuland, from the state department, these don't resolve all of my issues or those of my building leadership. all of this points to political consideration, when we now know they knew the truth. so the word "cover-up" has to come in to play here. your reaction. >> yeah, look. i think it's very clear that many of the things that the white house told us about the talking points, told us about the attacks, then told us about this process, are not true. you have to go back and sort of look at this in totality.

one of the things that i think is most striking about these documents there's nowhere in the 12 drift travis o drafts of theg points was there reference to a youtube video, and only on page 93 and 94 is there any reference at all to a movie. those emails, with that reference to a movie, the emails that come out of this deputy's committee meeting on saturday morning where many of these changes were implemented. so i think, you know, that raises additional questions about if -- if all of these people are contributing their ideas, trying to figure out what to tell the american people about what happened in benghazi, and there aren't any references to the youtube video in the actual talking points, an nobody in all of this email traffic makes any suggestion that we include this point about the youtube video, which of course became a central part of the administration's explanation as to what had happened in benghazi. >> sean: all right. let's go back to the hearings last week, and gregory hicks, the things that he said, the

things that we learned. we learned that the cia warned that they better prepare for the worst case scenario, an attack. we know there had been earlier requests for additional security. all of these were denied. denied by who, we still haven't fully confirmed. then during the attack we, have two stand-down orders. we also learned that hicks said the last words by ambassador stevens were "we're under the attack." those were the last words he used. nobody sought out hicks, nobody sought out information from those on the ground. then the coordinated effort to keep the press, the media, keep the country from hearing from people who actually knew what happened that day before they put together talking points, that as it says on page 46, the state department has major reservations with most or much of the document, wee revised document with those concerns in mind, then on page 93 they get into this elaborate story that had nothing to do with it, and

nobody there said it did, about a youtube video, etc. >> yeah. i think you're right. i think you sketched out exactly the difficulties the white house will face in trying to answer these questions. i think it's very difficult, these emails, for the white house to explain, for the state department to explain, for jay carney to reconcile some of the things that he had said before with what we now see in front of us. i think this will lead to reporters asking a good number of additional questions about these things. i mean, you made an illusion earlier, a reference to direct contact between state departmeny staff. what was that? >> sean: yeah. >> we know there was an email from jake sullivan, a senior hillary clinton advisor describing the exchanges that he had with tommy vietor. i'll read the quote exactly so i get it right. "talk to tommy. we can make edits." this comes after the white house has insisted that this was a totally intelligence-driven product. >> sean: that's the state department and the white house. >> that's the state department

and the white house. >> sean: yeah, making further edits. two things here. one is -- i won't belabor this point, but when jay carney lied and said there were only style listening differences, frank -- stylistic differences, he should be fired, because he can't be trusted. i would people in the press room have lost all confidence in him. the bigger picture here, all of this -- you know, when we talk about the state department having major reservations with much or most of the document, which it says in the emails, well, is that hillary clinton? we need an answer. >> right. >> sean: the second thing we need an answer to is about president obama. the president that night, by all accounts, never went back to leon panetta, never went back to hillary to get an update on the situation on benghazi. he went to sleep, got up the next day, went out campaigning. then two weeks later on "the view," before the united nations, was still echoing something that all of us knew was false, that by then he

should have known was false. so doesn't he have questions to answer here? what did he know, when did he know it, why was he repeating a lie two weeks later? >> absolutely he has to answer. he's the one, we don't have any accounting for the vast part of that night. hillary clinton, as you say, these are many of her top advisors, coming up with changes, or pushing revisions. is it really possible she didn't know? >> sean: who are the people in the state department we're referring to, what did they know it, why did they know it, and the reason we need to prevent this from happening again, and the perso american people, and e families who lost loved ones, have a right to know. anything you want to add? >> no. this raises additional questions. >> sean: steve hayes, you're way ahead on the curve on this. applaud you and give you credit. >> thanks, sean.

losing ohio. there's dozens and dozens of tea party groups in ohio. so what they said is, we're going to destroy the tea party by keeping them tamped down with their political activities. instead of going out to register new voters, the tea party, what were they doing, responding to the irs with page after page. so the 4 million fewer voters who voted for romney, voted for mccain, 4 million less, because they attacked the party and took away their ability to organize, just like benghazi, committee to re-elect the president was all about not national security, but obama's re-election security. the irs was all about electing obama. i would say this to my friend joe trippi. your buddy, bob beckel on "the e five," he said he lied, that it was about election security, not national security, and said it was a cover-up. do you join beckel in saying this was a cover-up, yes or no?

that this was a cover-up to protect a re-election effort, and you don't have to be a rocket scientist to figure out that these folks hated the tea parties. they called them -- the president called them tea baggers. he said he wanted to punish his enemies. this is what he's all about. >> sean: very chicago. >> yet we still have to be thorough in the investigation to connect the dots and make the case to the american people. >> sean: you have demanded that -- you think eric holder should resign. tell us why. >> for one thing, it's a long list of -- i think just attacks on the american constitution. you remember this? the christmas day bomber, ready-to-go the miranda rights to the christmas day bomber, claiming that he would read legal rights to the dead corpse of osama bin laden, claiming that -- that in fast and furious, obviously, claiming he had nothing to did with that

>> sean: this is the fox news alert. bottom administration has released 100 pages of benghazi-related emails that directly contradict what press secretary jay carney has been telling us since the beginning. the documents confirm that the white house and the state department played a large role in changing the benghazi talking points. also breaking tonight, attorney general eric holder testified on capitol hill earlier about the ap scandal. before he entered the building, he was asked -- >> will you appoint a special counsel to investigate benghazi? >> no. >> sean: joining me senator lindsey graham $2.. let'graham.

let's start with benghazi, the document dump. what do you take out of the emails? >> i haven't seen the emails. they had to be released because the pressure is building on multiple fronts. for the first time we're beginning to get information in the white house's involvement in changing the talking points. if i could have answer to one question out of benghazi it would be the following -- who chose susan rice to go out on sunday, the 15th of september, to tell a story so disconnected from reality? >> sean: we'd like to know the answer to that. are you confident that we have all the emails or do more exist? >> there's a lot more emails about how the talking points were manipulated. >> sean: so you think what where got tonight was selected, edited, redacted, this does not in any way tell the true story, because it does reveal that the white house -- by the way, it proves that jay carney is a total propaganda hack liar, that he should not -- he should be

fired. that's number one. number two, it also shows that the state department was up to its eyeballs in creating this lie, and that there were political considerations, both at the white house and within the state department. >> do these emails tell us how the talking points got changed from the intelligence central and eastern oregon what susan susan rice was the most politically compliant person close to the president, didn't know baning benghazi, but auditioning for secretary of state. did they tell us how that came about? >> they had the talking points right, were going to tell the american people the truth, and it evolved into an elaborate web of lies where nothing was true. how did we get to that point? >> well, because of the election. you don't have to be sherlock holmes to figure this out. the story of benghazi, if accurately reported, would undercut the narrative bin laden's dead, al-qaeda's on the run, and they manipulated the

appropriate way on the irs side. you know, he's not defending what happened. he's saying we're going to get to the bottom of it. good job, mr. president. here's what i'd like him to say about benghazi. i'm here by as commander in chief, president of the united states, authorizing every agency of the government who has a survivor or someone who participated in benghazi the ability to come forward and talk to the congress without fear of reprisal. i'm going to turn over to the congress all the relevant documents, all the survivors, all those who participated, and let the chips fall where they may. i wish he would do that. >> sean: i wish he would too. you are working with members of congress for a joint resolution to do what? >> in case he doesn't do that, i'm going to try to challenge our democratic colleagues who have been stonewalling, defending the administration to a fault on benghazi. we'll do a joint resolution of the house and senate, insisting that the administration make available to the congress, the names of the survivors so we can

interview them, all the relevant information, and those who participated in benghazi, so we can get to the truth. if you're going to provide to the accountability review board access to the survivors, all the documents surrounding benghazi, you should do the same for the congress. i'm challenging my democratic colleagues to stop defending this administration, start pushing for the truth when it comes to benghazi. four americans lost their lives in a death trap. how did it become so -- such a death trap before? why couldn't we help them during the attack for 7 1/2 hours and how did the story change so dramatically seven weeks before an election? >> sean: we've got a partial document dump today. >> right. >> sean: this is over 8 1/2 months later, and you still don't know who the survivors are, nor have you had the opportunity to speak with most of them? >> isn't that unbelievable. eight months after the attack, we haven't heard one word, israelvoluntarily, 48 survivor t
